CONSTITUTION OF THE CO-OP SPORTS AND SOCIAL CLUB
“Rock Lea” Dane Avenue Barrow in Furness
1 The Club shall be called the Co-op Sports and Social Club
2 The object of the Club is to provide facilities for and promote participation of the whole community in the Sport of crown green bowling, short mat in–door bowling, Keep-Fit Dance & darts
3 The ground situated at Dane Avenue shall be called Rock Lea.
4 The Club shall open at 11.00 am and closed at 11.30 pm – Monday to Saturday. 12 noon until 11.00
pm Sunday. As required.
The Club has a License to sell alcohol 24 hours per day 7 days per week excluding Christmas Day.
The opening hours of the Club will be set by the Committee to suit the requirements of the members.
5(a ) Membership shall be open subject to legal limitations and approval by the General Committee.
(b) Members may nominate one friend subject to (a) above.
(c) All members shall be entitled to vote at General Meetings of Members.
(d) Spouses of members must become FULL members to enjoy ALL CLUB FACILITIES
6 Membership of the club shall be open to anyone interested in the sports listed under clause ‘2’ on application regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs.Howeve ir limitation of membership according to available facilities is allowable on a non- discriminatory basis. 7 The Club may have different classes of membership and subscription on a non-discriminatory and fair “ basis. The Club will keep subscriptions at levels that will not pose a significant obstacle to people participating. (new 04/06)
8 The Club may refuse membership or expel from membership only for good and sufficient cause, such as conduct or character likely to bring the Club or sport into disrepute. Appeal against such a decision may be made to the Club’s members and decided by a majority vote. (new 04/06)
- Children will be admitted to the ground when accompanied by members who will be responsible for their good conduct.
10 Members children, 12 years and over may be accompanied by Associate Playing Members (Bowling only) at the discretion of the General Committee.
11 Annual membership cost will be such sum as decided by the General Committee to ensure the viability of the Club. Subscriptions for members shall be due on 1 January. Members who have not paid by 31 May in any one year shall not be members.
12 Life Membership cost will be such sum as decided by the General Committee to ensure the viability of the Club.
13 Life Members who do not attend the Club during the whole of any accounting year ending 31st December shall be deemed to have surrendered their membership and will be transferred to the organisation to be known as ‘Friends of the Co-op Sports & Social Club’.
14 Ex Life Members who are part of the ‘Friends of the Co-op Sports & Social Club’, can have their Life Membership re-instated by attending the Club and signing in as a visitor on 4 occasions in any one accounting year ending 31st December.
15 A General Committee consisting of Chairperson, Secretary, Treasurer, and seven committee members shall control the Club.
16 The Executive officials and members of the General Committee shall be elected for a two-year term of office with half of the General Committee retiring on an alternating annual basis but they will be eligible for re-election.
17 The Bowling section shall be managed by a Sub-Committee consisting of Chairperson, Secretary and representatives from each section of bowling members, Ladies, Gentleman and Senior Citizens
18 The Chairperson and Secretary of the General Committee shall be ex-officio members of all Sub- Committees.
19 Not less than 50% of any Committee shall form a quorum.
20 Committees may fill casual vacancies, caused by registrations or otherwise at their own discretion.
21 Any member of the Committee failing to attend three consecutive ordinary meetings without reasonable cause will be considered to have resigned and the vacancy shall be filled by the committee in question. Committee members unable to attend meetings shall notify the Secretary of that committee.
22 The General Committee shall control all income and expenditure of the funds of the Club and all other subscriptions and other cash receipts derived from whatever source shall be added to the general funds of the Club.
23 The funds of the Club shall be kept in such banks, as the committee may desire.
24 The financial year of the Club shall close on 31 December and a statement of accounts shall be presented at the Annual General Meeting.
25 Auditors, who shall not be members of the General Committee, shall be appointed at the AGM of the Club and their duties will be to audit the books and accounts of the Club.
26 25(a) There shall be two Trustees of the club who shall be appointed from time to time as necessary by the Committee of the club from among club members who are willing to be so appointed. A Trustee shall hold office during his/her lifetime or until he/she shall resign, by notice in writing given to the committee, or until a resolution removing him/her from office shall be passed at a meeting of the committee by a majority comprising two-thirds of the members present and entitled to vote.
25(b) All the property of the club, including land and investments, shall be held by the Trustees for the time being, in their own names so far as it is necessary and practicable, on trust for the use and benefit of the club. In the event of death, resignation, or removal from office of a trustee, the committee shall nominate a new Trustee in his/her place, and shall as soon as possible thereafter take all lawful and practicable steps to procure the vesting of the club property into the names of the Trustees as constituted after such nomination.
25(c) The Trustees shall be effectually indemnified by the Committee out of the assets of the club from and against any liability, costs, expenses and payments whatsoever which may be properly incurred or made by them in the exercise of their duties of relation to any property of the club vested in them, or in relation to any legal proceedings, or which otherwise relate directly or indirectly to the performance of the functions of a Trustee of the club.
25(d) (To be incorporated in every contract, Lease, Licence or other agreement entered into by the Trustees of the Club)
The liability of the Trustees for the performance of any contractual or other obligation undertaken by them on behalf of the Club shall be limited to the assets of the Club.
Non profit making
27 All surplus income or profits are re-invested in the Club. No surpluses or assets will be distributed to members or third parties. (new-04/06)
28 Upon dissolution of the Club any remaining assets shall be given or transferred to another registered CASC, a registered charity or the sport’s governing body. (new 04/06)
Powers & Duties of Committees
29 The General Committee shall superintend the conduct of the Club in accordance with these rules and shall be responsible for all financial matters. They shall employ and remunerate all workmen as may be necessary for the upkeep of the ground and premises.
30 The General Committee, at their discretion may close the ground and /or pavilion against members and charge for entrance at any time for the purpose of special functions they may authorise or organise more particularly of raising funds for the Club. Not less than seven days notice of such intention must be given to members.
31 The General Committee may appoint sub-committees for any purpose they may think desirable and shall in the event of any Sectional Committee or officials not functioning satisfactorily supersede such committee or officials.
32 The Sectional Committee shall superintend their respective sports as may be necessary. They shall not be empowered to pledge the credit of the Club in any way and shall make recommendations to the General Committee regarding proposed expenditure.
33 Sectional Committees shall draw up rules and byelaws for the governance of their sections conforming the meaning and spirit of these rules. The game shall be accepted by a general meeting of the section concerned and submitted to the General Committee for their approval.
34 Sectional Committees are empowered to organise sports relating to their own sections and to enter leagues and competitions but such arrangements shall be subject to approval of the General Committee.
35 Sectional Committees shall meet as often as necessary for the proper conduct of their sport.
36 All trophies shall remain the property of the Club, unless specially stated to the contrary and shall be offered for competition as may be directed by the General Committee.
37 The AGM of the Club shall be held in February each year. The officials and members of the General Committee shall be elected at this meeting.
38 Sectional General meetings shall be held prior to the commencement of the season for the section concerned. Election of officials and committee for the ensuring season shall take place at this meeting..
39 Fourteen days notice shall be given of all General meetings.
40 A copy of the rules shall be displayed within the Club building at Rock Lea at all times.
41 The General Secretary shall issue membership cards and members will be required to produce their membership card on demand by any responsive official at any time on the ground. Members losing their membership card must report the loss to the General Secretary immediately and shall pay a fee for a new card.
42 Visitors may be introduced by members of the Club but not more than 4 times in any one year. The visitor and the member introducing the visitor shall sign their names in the book provided for that purpose. No visitor shall be allowed to pay for any kind of drink at the club. No person who has been expelled, or whose nomination has been rejected, or who is in debt to the Club shall be accepted as a visitor. This rule does not apply to visiting teams.
43 The dates of the start and finish of the playing seasons shall be determined by the General Committee.
Interpretation of rules
44 The decision of the General Committee shall be binding in the interpretation of these rules and where the rules are silent subject to the right of appeal.
Alternation of Rules
45 These rules may only be altered at a General Meeting of members and such alterations must be supported by two thirds of the members present and voting before being adopted.
46 Fourteen days notice of motion must be given for a proposed alteration to the Rules.
